CONTRACTS FORMATION SUPERVISOR Provides functional direction and/or supervision to all contracts personnel assigned to a project or office, in accordance with applicable directives, management instructions, procedures and functional guidelines. Provides functional guidance on issues related to contracts, and coordinates functional activities with other functional managers. Performs formation and administration of all types of commitments when required by workload, complexity or other factors. Position Duties/ responsibilities SUMMARY Works with Formation Supervisor to develop contract strategies for review and presentation to senior project and client management. Undertakes contract formation activities including assembling RFP documentation, administering the tender process, completion of the evaluation process and preparation of the evaluation report. Administers large, complex contracts. Maintains a continuing review of the progress of each contract and provides management with information regarding any financial, legal or technical difficulties. Prepares change order and amendments, negotiates with contractors and customers to obtain settlement. JOB DIMENSIONS Supervision Received Reports directly to the Contracts Manager - Port Zone. Receives technical and functional guidance from the Contracts Manager. Supervision Exercised May provide operational supervision to contract Specialist(s) and/or other contract Administrators. Contacts Maintains internal contacts with other disciplines during any assigned formation activities and will receive instruction from the assigned Resident Engineer for an awarded contract to which he or she is assigned. EFFECTIVE JOB DUTIES Work with other team members to assemble a major RFP package if assigned. Administer the tender process and complete the evaluation process under the supervision of the Contracts Formation Manager Implement the Division of Responsibilities Matrix which records the Project's agreed assignment of various contract management tasks and the Standard Work Process Procedures applicable to Contract Administration. Administers assigned contracts maintaining a continual review of progress and providing management with information regarding projected financial or technical difficulties. Analyses contract terms, contract deliverables and payment applications. Coordinates with designated staff on operational activities affecting contractual rights and obligations, contract performance, contract administration and other major matters. Administers complex contracts and contract changes by negotiating with contractor, presenting an evaluated position to the customer for acceptance and obtaining settlement. Represents ADPC in complex contractual discussions. Administers information programs to ensure mutual understanding of contract terms and conditions. Prepares periodic status reports for management. Prepares and reviews incoming / outgoing correspondence for and on behalf of the Resident Engineer. Position Skills Demonstrated experience in contract development, as well as administration of major construction projects Demonstrated knowledge of commercial practices and legal principles Experience in review, analysis, defense, etc. distinguishing contractor? claims. Familiarization with arbitration procedures and administration. Sound knowledge of contract regulations, policies and practices. Experience in developing contract types, fee arrangements and contract terms. Experience in developing and recommending potential solutions to contractual problems to management. Demonstrated oral and written communication skills. Other Remarks/ Qualifications B.S. or equivalent degree in Engineering from and accredited university Relevant experience in major projects in the infrastructure or energy industry. Experience in similar position with the PMC's organization preferred. | |
